La transición política a la democracia en Chile enfocada desde los proyectos de reformas constitucionales incentivadas hacia la carta de 1980

Resumen
La presente memoria, consiste en analizar y comprender cómo es que los proyectos de reformas a la constitución de 19801 fueron fundamentales para el proceso democrático que actualmente vive Chile, es decir cómo ellos influyeron en el asentamiento de la democracia. Para alcanzar nuestro objetivo es menester analizar los intentos de reformas constitucionales, presentadas durante el periodo del régimen militar del general Augusto Pinochet; abocándonos a estudiar los proyectos de reformas que se presentaron durante los gobiernos de los presidentes Patricio Aylwin y Eduardo Frei Ruiz-Tagle. Siendo de nuestro especial interés estudiar los proyectos de reforma que nunca lograron convertirse en ley, a fin de poder comprender el porqué de su fracaso y sobre todo entender cuál fue el espíritu que los motivó. Estudiaremos su discusión en el congreso al momento de ser propuestos; quiénes estuvieron detrás de la redacción; qué dijeron los partidos políticos sobre estos proyectos; cómo se hicieron estos proyectos y en qué plazo; cuál fue la postura de los autores acerca de ellos. Explicaremos el proceso de la transición no solo desde un ángulo normativo y positivo, sino desde un doble enfoque normativo-político, de ahí la importancia de conocer las posturas de los partidos políticos y, lógicamente, el rol que cumplieron las fuerzas armadas. El periodo de nuestra historia, denominado de transición política produjo un cambio sustantivo de todo orden y sus huellas quedaron plasmadas inequívocamente en nuestra carta fundamental. El cambio ocurrido en Chile en el orden constitucional, dice relación, entre otras cosas, con el pensamiento de aquellos que fueron promotores de las reformas sugeridas a la carta, y aunque no todos los proyectos lograron sus objetivos, plasmaron una intención emanada de diversos sectores de disímiles tendencias políticas. Lo anterior nos impulsa a intentar comprender cuáles fueron los aires que se respiraban. Entonces y por ello es importante conocer qué hay detrás de cada uno de los proyectos de reforma que se intentaron llevar a cabo. Es este en consecuencia uno de los capítulos más importantes y controvertidos de la historia política contemporánea de nuestro país: la transición a la democracia.
This thesis consists of analyzing and understanding how the reform projects to the constitution of 1980´s where fundamental for the democratic process that is currently in Chile, in another way, how they influenced in the democratic establishment. To achieve our objective we have to analyze the constitutional reform attempts, which were introduced during the military government of Augusto Pinochet, to study the reform projects which were introduced under the government of Patricio Aylwin and Eduardo Frei Ruiz-Tagle. Hence, we are interested in studying the reform projects which never could be turned into a law to understand the reason of this failure and why they were motivated to do this, we are going to study its argument in the congress at the moment of being proposed. Who wrote them the political parties’ opinion about them, the way of doing these projects and how much time they were done in, and the opinion of their authors. We are going to explain the transition process not only in a positive and regular way, but in a double regular and political way. Thus, the importance knowing the political parties´s point of view, and the role that the army forces played. The period of our history, known as the political transition produced and important and general change in public life, and the meaning of this transition is present in the political constitution of the country. The change experienced in Chile regarding the constitution order, is based on, among others, the thought of those who prometed the amendments suggested for the constitution, even thought not all the projects were carried out, they left an idea from many different political points of view. The above invites us try to understand the period they were living in. Hence, it is important to know what is hidden on every project modifying the constitution which were tried to be introduced. Eventually this is one of the most important controversial periods in the contemporary political history of Chile: the transition to democracy.
