Resumen
A diferencia de otros países, Chile no cuenta con algo que pueda denominarse, con mayor o
menor grado de sistematicidad, “derecho penal del trabajo”. Este estado de cosas resulta
particularmente llamativo si se consideran algunos valiosos intentos de teorización científica
y, en particular, su progresiva consagración en el derecho comparado. Para tener claridad de
las razones que puedan explicar lo anterior es prioritariamente necesario, sin embargo,
despejar la elemental pregunta en torno a lo que se quiere significar cuando nos referimos a
él. Ese es, en efecto, el principal propósito de esta breve investigación: aproximarnos a una
respuesta frente al interrogante del sentido y alcance que tiene la expresión que acompaña a
la denominación de la disciplina y, sobre todo, su ubicación y estatus en términos de
epistemología jurídica.
Differently from other countries, Chile lacks any kind of concept of what could be called, with a greater or lesser level of systematisation, “Criminal Labour Law”. Such a situation is particularly striking if one considers some valuable attempts at scientific theorisation and its progressive enshrinement in comparative law. However, in order to be clear about the reasons for this context, it is primary to clarify the elementary question of what is meant when we refer to Criminal Labour Law. Such is, precisely, the purpose of this brief paper: to approach an answer to the question of the meaning and scope of the expression Criminal Labour Law as a discipline, as well as an analysis of its location and status in terms of legal epistemology © 2023 Centro Estudios Derecho Penal.
