Resumen
Al hablar de violencia en la relación de pareja, se piensa principalmente en la violencia ejercida desde un hombre hacia una mujer. Esto debido a que de manera tradicional y cultural, la población Chilena está compuesta por parejas heterosexuales, y dentro de la crianza patriarcal, la mujer es considerada como indefensa, sumisa y vulnerable. Es por ello que la violencia que puede producirse entre las parejas homosexuales, es una problemática social totalmente invisibilizada y un ámbito desconocido en la Política Pública y Legislación Chilena.
Debido a que no existen estudios en Chile que aborden la problemática expuesta, es que se realizó la presente investigación, se estima su desarrollo desde octubre del año 2016 hasta julio del 2017, sin embargo podría extenderse en el tiempo según el desarrollo de la investigación y posterior análisis lo requiera. Lo anterior se encuentra enmarcado en la temática del Derecho de familia, en específico dentro del contexto de las nuevas formas de constituirla. Además pretende en primera instancia es conocer si existe violencia intrafamiliar en las parejas homosexuales de género masculino encuestadas, y si esto es así, dar a conocer los resultados de dichas encuestas de personas homosexuales que sufren o han sufrido violencia, a través de datos estadísticos que den a conocer el ejercicio de violencia en la relación de pareja, así como los tipos de violencia que se generan entre los encuestados. Esto enmarcado en un rango de las relaciones que han llevado dentro de los últimos 5 años.
When talking about domestic violence, authors mainly refer to the violence exerted from a man towards a woman. This is due to the traditional and cultural heritage of Chile, which potrays the main sexual ideology of its population as heterosexual. Within the idea of patriarchy women are considered defenseless, submissive and vulnerable. It is for this reason that the potential violence between homosexual couples is an invisible and unstudied social phenomena that escapes the scope of Chilean’s public affairs, policy and legislation. The present investigation aims to provide some answers in this matter, since there are no studies in Chile that address the problems above described. This work was conducted and developed from October 2016 to September 2017, and it’s framed in the legal aspects of “Family law” within the context of new forms of constituting families in the modern Chilean society. First and foremost, the investigation aims to confirm the existence of domestic violence in male-homosexual couples by using a survey. Secondly, study the acquired data about homosexuals who suffer or have suffered domestic violence, through a statistical analyse that aims to reveal the exercise of violence in those relationships, as well as the types of violence that are identified among the respondents. Each participant has given his answers considering the relationships they have had within the last 5 years.
