Esta investigación busca describir e interpretar los discursos de profesionales que se
desempeñan en el ámbito judicial respecto a la noción de maldad como un sesgo en
los procesos de intervención.
Este estudio surge a partir de la inquietud de reflexionar sobre las nociones de maldad
que puedan estar incorporadas en las intervenciones de profesionales que se
desarrollan en el ámbito judicial, las causales que consideran que pueden llevar a una
persona a delinquir y la existencia de una relación entre patologías, contextos y
estructuras. La investigación está compuesta por tres grandes partes, la primera es
una conceptualización de los sesgos, dentro de un marco histórico e institucional. En
la segunda se encuentra el método de levantamiento de información de carácter
cualitativo por medio de entrevistas semi estructuradas y posteriormente el
procesamiento de datos a partir del método de contenido temático. Y en tercer lugar
se encuentran los resultados, en cuanto a estos se pudo comprobar que no existe un
sesgo sistemático en los profesionales del ámbito judicial en relación a la noción de
maldad, también se levantaron dos grandes áreas que engloban todas las causales
mencionadas por los informantes que son: lo social, los contextos, etc. Y lo
psicológico, la personalidad. Por último, se revelaron una serie de nuevos desafíos
para los profesionales del Trabajo Social en relación a este complejo e interesantísimo
fenómeno social.
This research seeks to describe and interpret the speeches of professionals that perform in the judicial system about the notions of evilness as a bias in the process of interventions. This study arises because of a restlessness regarding a reflection about the notions of evilness that can exist in the interventions of professionals in the judicial system, the causes they believe can lead a person to offend and the existence of a relation between pathologies, contexts and structures. The investigation is composed of three big parts, the first one is the conceptualization of bias, inside a historic and institutional frame. In the second is the method of gathering information based on a qualitative character through semi structured interviews and later the prosecution of data based on the method of thematic content. In the third place the results may be found, as for these it could be verified that there is no systematic bias in relation to the notion of evilness regarding the professionals that work in the judicial system. Also two large areas were raised that encompass all the causes that were mentioned by the informants; these are the social one, the contexts, etc. And the psychological, the personality. Last, a series of new challenges were revealed for the professionals of Social Work in relation to this complex and very interesting social phenomenon.
