Institución y derecho en el giro normativo político deleuzeano: una lectura de la jurisprudencia como variación

Resumen
El esfuerzo moderno por articular Soberanía y Ley tiene por horizonte el tratamiento de lo institucional confinado a la estructura de la representación, desde la aplicación del derecho y la ley hasta la configuración de lo estatal. Se problematiza el plano representacional del Derecho y su implementación de leyes y derechos, para ampliar sus fronteras y cuestionar la operación de estas clásicas asociaciones. Se abre un camino fructífero para pensar una concepción del derecho y la jurisprudencia en relación con la teoría de la institución deleuzeana y su vínculo con lo social, tensionando al máximo el binomio ley-representación. La filosofía del derecho propuesta por Deleuze establece una base, en tanto práctica de casos singulares, que puede encarnarse en la propia idea de filosofía inmanente del francés. Hay un mundo a desenvolver en esta perspectiva del derecho como crítica a la Ley abriendo otra práctica legal que resuena en la actualidad. Dicho esto, el artículo propone desentrañar, desde una lectura crítica deleuzeana, un modo de normatividad política de los derechos que señala la relevancia de la jurisprudencia como variación, dando cuenta de la interacción deformante de la experiencia social respecto al derecho y, a su vez, de posibles nuevas dimensiones de la institución.
The modern effort to articulate Sovereignty and Law has as its horizon the treatment of the institutional confined to the structure of representation, from the application of Law to the configuration of the state. The representational plane of Law and its implementation of laws and rights are problematized, to expand its borders and dispute the operation of these classic associations. A fruitful path is opened to think about a conception of law and jurisprudence in relation to the Deleuzean institutional theory and its link with the social, stressing the binomial Law – representation to the maximum. The philosophy of law proposed by Deleuze establishes a basis, as a practice of singular cases that can be embodied in the Frenchman's own idea of immanent philosophy. There is a world to unfold in this perspective of law as a critique of the Law, opening another legal practice that resonates today. Therefore, the article aims to unravel, from a Deleuzean critical reading, a political normativity of rights that points to the relevance of jurisprudence as a variation, accounting for the distorting interaction of social experience with respect to law and also possible new dimensions of the institution. © 2024 Instituto Tecnologico y de Estudios Superiores de Monterrey.
